1. About These Terms

These Terms of Service ("Terms") govern your use of the Grind Clock mobile application ("the App") published by STATU CO, a company registered in France ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

2. Description of the App

Grind Clock is a time tracking application for iOS that allows you to categorize your time as productive ("grind") or non-productive ("wasted"). The App runs continuously and provides real-time tracking, a 24-hour arc gauge, and a weekly calendar view.

3. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you confirm that you have obtained parental or guardian consent before using the App.

4. Account & Data

The App does not require account creation. All data — including your sessions, daily records, and settings — is stored locally on your device. We have no access to your data and cannot recover it if your device is lost, damaged, or reset. You are solely responsible for backing up your device.

5. Subscriptions & Pricing

The App offers two auto-renewing subscription plans:

Both plans include a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and your payment method will be charged.

Subscriptions are billed through your Apple ID account via the App Store. Payment is charged at confirmation of purchase (or at the end of the free trial). Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

You can manage or cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions. Cancellation takes effect at the end of the current billing period — you retain access until then.

Prices may vary by region due to App Store currency conversion. We reserve the right to change pricing with reasonable notice. Any price change will apply to the next billing cycle after the change.

6. Free Trial

New subscribers are eligible for a one-time 7-day free trial. If you have previously subscribed or used a free trial, you may not be eligible for another trial. Apple determines trial eligibility based on your Apple ID.

All purchases and subscription payments are processed by Apple. Refund requests must be submitted directly to Apple through their Report a Problem page. We do not have the ability to issue refunds.

The App, including its design, code, graphics, and content, is the property of STATU CO and is protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features. The name "Grind Clock" and associated branding are trademarks of STATU CO.

10. Privacy

Your privacy is important to us. Please refer to our Privacy Policy for information on how we handle data. In summary: all your data stays on your device, and we do not collect personal information.

11. Third-Party Services

The App uses RevenueCat to manage subscriptions and in-app purchases. RevenueCat operates under its own terms and privacy policy. By using the App's subscription features, you also agree to RevenueCat's Terms of Service.

The App is distributed through Apple's App Store. Your use of the App Store is governed by Apple's terms. In the event of a conflict between these Terms and Apple's terms regarding the App Store, Apple's terms shall prevail for matters related to the App Store.

12. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. STATU CO does not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components.

13. Limitation of Liability

To the maximum extent permitted by applicable law, STATU CO and its officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from or related to your use of or inability to use the App, regardless of the theory of liability.

In no event shall our total aggregate liability exceed the amount you have paid to us for the App in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless STATU CO from and against any claims, liabilities, damages, losses, and expenses arising from your use of the App or your violation of these Terms.

15. Termination

We may terminate or suspend your access to the App at any time, without prior notice, if you breach these Terms. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) shall remain in effect.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

17. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of laws provisions. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in France.

If you are a consumer residing in the European Union, you retain the benefit of any mandatory consumer protection provisions of the laws of your country of residence.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and STATU CO regarding your use of the App and supersede all prior agreements and understandings.
